WAIVER AND RELEASE OF LIABILITY: I hereby acknowledge and understand that Brazilian Jiu-Jitsu is a physical activity, placing physical demands on my physical and mental stamina. I further understand that this activity will involve physical contact with other individuals. Knowing these facts, I further acknowledge that I am assuming any and all risks involved with this activity. I specifically agree that Bill Brazilian Jiu-Jitsu Association, Inc., its staff and students will not be held liable for any and all injuries or damages experienced by me while engaged in activities during training or as a result of or aftermath of training Brazilian Jiu-Jitsu. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and Bill Brazilian Jiu-Jitsu furnishing services to me, I agree, for myself, my family, my heirs, and my assigns and anyone else who may be entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE Bill Brazilian Jiu-Jitsu, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, for injury, death, negligence, property loss or damage suffered by me as a result of my participation in the program, or my use of the facilities or claims of any kind arising out of my participation in the Bill Brazilian Jiu-Jitsu training, programs and or events, whether injury, loss or damage is caused in whole or in part by my fault or negligence, the fault or negligence of the Releasees or the fault or negligence of any third party. I, acknowledge that I know, understand, and appreciate the inherent risks of participating in this program, using the facilities or the equipment and of participating in Bill Brazilian Jiu-Jitsu. I know that these risks may include, but are not limited to minor scrapes, strains, and bruises, as well as significant injuries such as broken bones, eye injury or loss, concussions, paralysis, and even death. By execution of this agreement, I fully assume the inherent risks associated with my participation in Bill Brazilian Jiu-Jitsu assert that I am voluntarily participating in such activities. I understand that by signing below, I have read this release of liability, fully understand it, freely and voluntarily sign the same, and I am acting for myself, my heirs, personal representatives and assigns. This Waiver and Release shall be governed in accordance with the substantive and procedural laws of the State of Florida without regard to conflicts of law.
MEDIA CONSENT: Member grants permission to Bill Brazilian Jiu-Jitsu Association to take and/or reproduce the photographs/video of member for the purpose of publication, promotion, illustration, advertising, or trade, in any manner or in any medium. Images may not be used for profit without my express written permission. Member understands that Member is not being paid or compensated for this authorization. If at any time member wishes to withdraw this authorization, Member must do so in writing to Bill Brazilian Jiu-Jitsu Association.
Student agrees to follow school rules as promulgated from time to time. Violation of these rules and behaving in a manner contrary to the best interests of the school or the school's members may be the cause for suspension or cancellation of membership at the discretion of Bill Brazilian Jiu-Jitsu Association.
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
BILL BRAZILIAN JIU-JITSU ASSOCIATION ("the Club") has put in place preventative measures to reduce the spread of COVID-19; however, the Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Club could increase your risk and your child(ren)'s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Club and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at the Club or participation in Club programming ("Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Club program.
